1. Black Square Executive Cars Term and Conditions

These terms and conditions constitute the entire agreement concerning the provision of an Airport Transfer or Long Distance Service (”Service“) between you and Black Square Executive Cars . Completion of the booking form and use of the service indicates your unconditional acceptance of the terms and conditions set out in this agreement. Black square Executive Cars is a trading name of Black Square Executive Limited.

Any changes sought by the customer to the terms or conditions shall have no effect unless agreed in writing by the Company.

Black Square Executive Cars is a private hire car company and works with its clients to provide the end user a safe and reliable transport method. If you require a receipt for your journey, which has been paid by cash or card you can request a receipt is emailed to you.

Bookings

Black Square Executive Cars will email you a quotation for your airport transfer or long distance journeys based on the information provided by you. Black Square Executive Cars reserve the right to amend the quotation if there is any material change to the original itinerary, the number of passengers, or the type of vehicle required.

Airport Transfers:

You must allow sufficient time when booking your car to allow for the check-in times required by your airline and for any delays caused by traffic conditions. Black Square Executive Cars shall not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

You must order a suitable car size for the number of passengers and luggage. Black Square Executive Cars cannot guarantee to carry excessive amounts of luggage. Please note that a child, no matter what age, counts as one passenger.

Black Square Executive Cars will always check for flight delays before the driver leaves for the airport but can only rely on the information supplied by the Airport Websites.

Once you have accepted your quotation, please check your booking confirmation carefully and inform Black Square Executive Cars promptly for any errors. Black Square Executive Cars shall not be responsible for any delays caused or costs arising from your failure to provide Black Square Executive Cars with correct information.

All car parking charges, drop off fees, congestion and toll fees shall be included within the quotation.

Payments can be made by credit, debit cards, and cash. Payments by cheque is not accepted.

A full receipt can be emailed direct to you or posted if required. Please note that an emailed receipt can take up to 48 hours. 

Account Work:

In respect of account work, Black Square Executive Cars works with their clients to ensure that the services are delivered as per the requirements of the customer.

The customer agrees to pay the company for all journeys provided by the company on account. We shall invoice after the journeys has taken place. Invoiced amounts shall be due and payable after 30 days from date of invoice.

The Service 'Vehicle Conduct'

You shall be responsible for the behaviour of all passengers in the car during the whole journey. A charge of £80.00 will be levied to cover the cleaning costs in the event that the vehicle is soiled by any passenger.

Eating and drinking in the cars is not permitted. Exceptional circumstances for babies and medical reasons will be permitted with prior permission. All children should be restrained in a manner that befits the laws and regulations at the time. Suitable child seats can be supplied but should be fitted by the child's parent / guardian. Black Square Executive Cars will not carry more passengers than its insurance or licensing allows.

Smoking is never permitted in any of our vehicles. 

Cancellations and Bookings

If you need to cancel your booking please contact Black Square Executive Cars as soon as possible. All cancellations made before the booking time will not incur a penalty charge. Refunds will be given at the discretion of Management. In exceptional circumstances, a penalty of up to 50% of the fare can be levied for late cancellations.

As a general rule journeys from airports are dispatched up to one hour before flight arrival, journeys within areas we provide a service to are normally dispatched up to fifteen minutes before their due time.

Invoices will be sent for cancellations of a booking that have not been pre-paid, These invoices must be paid within 30 days and any unpaid invoices will incur a minimum 10% charge of the original invoice amount. The time stipulated for payment shall be of the essence of the Agreement. Failure to pay within the period specified shall entitle us to write to you and upon the expiration of seven days notice, to charge you for costs and expenses incurred in recovering late payments, and to charge interest at the rate then in force pursuant to the Late Payment of Commercial Debts (Interest) Act 1998 as at the due date or on the above rate whichever is the greater.

Black Square Executive Cars recommends phoning us on our contact number to cancel with the telephone staff.

Refunds to credit / debit cards can only be refunded to the original card used within 7 Days of the original booking date. 

Liability

Black Square Executive Cars shall use all reasonable endeavours to get you to your destination on time, but shall not be liable for any loss due to delays caused by road or traffic conditions beyond its control on the journey. Under no circumstances shall Black Square Executive Cars be liable for any loss of profits, business or for any indirect or consequential loss whatever. Black Square Executive Cars aims at running a reliable service for you, however sometimes cars cannot arrive at time of booking due to reasons beyond our control. If the car is running late please contact the control immediately for an update.

All luggage is carried entirely at your own risk. Lost property is kept by the office for a period of 2 weeks before being disposed off.

Black Square Executive Cars is entitled to cancel all services and provide up to 100% of the refunds (with in 7 Days of the original booking date), in the event of circumstances beyond their control. If a car breaks down during the journey, Black Square Executive Cars will provide an alternative with a practical time allowance.

You shall indemnify Black Square Executive Cars against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.

Black Square Executive Cars acts as an agent for clients of self employed drivers, and will pass information relating to the customer in order to assist with the safe and timely pick up. Black Square Executive Cars cannot be held responsible for the misuse of this information by its clients or subsequent drivers that are beyond its control.

Neither party excludes or limits its liability for death or personal injury caused by negligence, or for wilful default or fraudulent misrepresentation, or otherwise in any manner unenforceable by any applicable law.

Termination

Black Square Executive Cars will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or your passengers, requesting that all passengers vacate the vehicle as soon as it's safe to do so.

No refunds will be given for journeys terminated part way through the hire, full fare will be due to the driver and/or invoice issued if the journey is not pre-paid.

Company rights and powers

Black Square Executive Cars may change these terms and conditions at any time by posting changes online. Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.

Black Square Executive Cars reserves the right to change the rules or instructions concerning the use of any part of the service from time to time.

Black Square Executive Cars reserves the right to change the service, suspend it temporarily, in the interest of quality of service, communication failure or part interest of other customers.

Customer Service

For any issues arising; please contact the control team who will attempt to resolve the issue immediately. In the unlikely instance a satisfactory resolution is not met, you can leave your name and number with the controller and a member of the management team will contact you within 24 hours.

Disputes

In the unlikely event of an event of a dispute arising, notice must be given within 21 days of the invoice date. In the event of no such notification being received by the company the customer shall accept the amount as being properly due and shall not be entitled to dispute this sum. 

Miscellaneous

Black Square Executive Cars shall store, process and use all information regarding your personal details in accordance with the requirements of the Data Protection Act 1998. The terms of this agreement shall prevail if a discrepancy arises between a quotation and this agreement.

This agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals oral or written.

The companies’ website may contain hyperlinks to third parties; The company does not control, is responsible for and does not endorse any of the contents of such websites.

Use Restrictions

Reproduction, distribution, or republication of any information, materials, documents and services by any means, without the prior express written consent of Black Square Executive Cars , is strictly prohibited. Nothing in this Black Square Executive Cars website shall be construed as conferring any license of Black Square Executive Cars 's intellectual property rights without express written consent from Black Square Executive Cars . All rights not expressly granted herein are reserved.

Warranties and Disclaimers

The information, documentation, products and services contained on the Black Square Executive Cars website are provided “as is,” without any warranty of any kind. Black Square Executive Cars and its suppliers disclaim all warranties relating to the information, documentation, products and services contained on the Black Square Executive Cars website, express or implied, including, but not limited to, any warranties against infringement of third party rights, merchantability and fitness for a particular purpose.

The Black Square Executive Cars website could include inaccuracies or out-dated information and is subject to change at any time without notice. Your use of this website is at your own risk.
